1. The trial version is provided to life sciences organization, which are intending to solve one or more regulatory compliance challenges (regulatory submissions, document management, quality management, pharmacovigilance submissions etc.) via software such as the Cunesoft regulatory operations software suite.
  2. Cunesoft provides the trial version only to life sciences organizations disclosing their company name.
  3. Trial requests from competitors will not be supported.
  4. The trial system entitles to access the applicable Cunesoft software only for thestated trial period and only in accordance with these terms and conditions.
  5. The trial is for evaluation purposes only. After the trial period, customer will not have access to any user account created in connection with the trial or any datacreated within any such account.
  6. Productive use of the software (i.e. submission publishing for productive productregistration etc.) is explicitly prohibited.
  7. Cunesoft may terminate the trial at any time, without notice, at its sole discretion.
  8. Customer may not copy or distribute any materials provided during the durationof the system trial.
  9. Customer must keep all information about the trial strictly confidential, andcustomer agrees not to disclose any such information to anyone other than individuals within Customers organization to the extent necessary to reasonably conduct Customers evaluation.
  10. Data provided by Customer for the purpose of the trial are Customer’s property and will be treated as such by Cunesoft. At the end of the trial; Cunesoft will remove and destroy all Customer data from its existing systems and/or upon request return data to Customer.
  11. The trial is provided as-is. Cunesoft disclaims all representations and warranties, express or implied, with respect to the free trial. In no event will Cunesoft be liable for any special, incidental, indirect, consequential or exemplary damages whatsoever arising out of the free trial. In no event will Cunesoft or its licensors be liable in damages.
  12. Customer acknowledges that the software as a service provided by Cunesoft is a copyright protected system according to § 2 Abs. 1 Nr. 1, § 69a of the German copy rights protection law (UrhG) and acknowledges that Cunesoft is copy rights owner of the system as per §§ 7, 69b of the German copy rights protection law (UrhG).
  13. The trial system project is governed by the laws of Germany in particular the German Civil Code, the German Commercial Code and German Patent Law. The place of jurisdiction is Munich, Germany.
